Property Terms
- Property is being sold AS IS, WHERE IS, with no warranties or guarantees expressed or implied.
- Any personal property, debris, or items remaining on the property after closing and/or possession date shall remain with the property and become the responsibility of the buyer.
- A 10% non-refundable earnest money deposit is required from the successful buyer.
- Any inspections desired by buyers must be completed prior to the close of the auction. No post-auction inspection contingencies will be accepted.
Closing & Possession
- Closing shall take place on or before July 16, 2026, unless otherwise agreed upon in writing by buyer and seller.
- Sellers shall retain possession of the property for up to 90 days after closing.
- Sellers will pay all utilities and related bills during the possession period until vacating the property and providing written notification to the buyer. Utilities will then transfer to the new owner.
- Sellers will maintain insurance coverage during the possession period.
- Final possession date shall be October 16, 2026 at 5:00 PM.
- If sellers fail to vacate by October 16, 2026 at 5:00 PM, sellers shall pay buyers a penalty of $500 per day until possession is delivered.
Taxes & Closing Costs
- Property taxes will be prorated through October 16, 2026, regardless of whether sellers vacate earlier.
- Buyer and seller shall split the cost of:
- Owner’s title insurance
- Title work
- Survey shall be waived unless required by the title company. If required, buyer and seller shall equally split the survey cost.
- Seller shall pay all applicable Michigan sales tax and any taxes related to this sale.
- Buyer shall be responsible for any lender fees associated with financing.
